What Are Catastrophic Injuries?

Catastrophic injuries are injuries that have a long-term or permanent effect on the life of the person who has been injured, and that may require significant medical treatment. Some people hurt in catastrophic accidents recover. Others may live with permanent disabilities, extreme suffering, a significantly shortened life span or a permanently altered way of life.

Catastrophic injury or illness can include brain injury, spinal cord injury, amputations, multiple fractures, burns or other congenital or neurological disorders. A catastrophic injury or illness very often causes severe disruption to the central nervous system, which in turn affects many other systems of the body. In addition to possible loss of movement, sensation and communicative and cognitive abilities, the injury or illness may impact breathing, circulation, skin, the urinary system, the gastrointestinal system and other body systems. Injuries classified as “catastrophic” can include loss of eyesight or hearing, severe burns or disfigurement, head injuries, or loss or paralysis of limbs.

A catastrophic injury affects how the patient lives. Each family member may have to make dramatic adjustments in their lives in order to care for the injured person. There may be life tasks that will have to be relearned, such as how to walk, talk or write. The patient may require a lifetime of medical care and/or repeated surgeries.

Catastrophic injury cases are among the most complex cases and should be handled with the help of an experienced attorney. What Is Wrongful Death?

Wrongful Death occurs when a person (the decedent) dies due to the negligence of another person, company or institution. Wrongful death cases may be the result of car accidents, construction site accidents, criminal attacks or medical malpractice. (A 1999 study from the Institute of Medicine showed between 44,000 and 98,000 hospitalized Americans die each year due to medical mistakes).

The following types of damages are considered in a wrongful death case:

  • Immediate expenses associated with the death (medical & funeral).
  • Loss of victim’s anticipated future earnings until time of retirement or death.
  • Loss of benefits caused by the victim’s death (pension, medical coverage, etc.).
  • Loss of inheritance caused by an untimely death.
  • Loss of services, protection, care, and/or assistance that the person who died provided to survivors and beneficiaries.
  • Pain and suffering, or mental anguish.

Generally you must be either the personal representative (a person who manages the affairs of another because of incapacity or death), the child, spouse or parent of the decedent, in order to bring a wrongful death case.

Most wrongful death suits are based on negligence, and as with all negligence suits, you will need to prove that the wrongdoer had a duty to act in a certain manner, failed to act in a responsible manner (breached the duty), and that such failure caused the death of your loved one.
